Cascade Gateway Foundation Update of Dec.18, 2005

Settlement reached with Cadman!

    

On Dec. 15, 2005, Cascade Gateway Foundation executed an agreement with Cadman, Inc. ending our challenge to their permit for the North Bend Gravel Operation (NBGO) under the Land Use Petition Act (LUPA). This move followed a detailed review of the circumstances, during which our board of directors determined that the settlement agreement will yield more long-term benefits for our community than would be available through continued litigation. Among the points in the agreement:

 

  1. CGF agreed to withdraw its land use petition currently in Superior Court.
  2. Both parties agreed to increase cooperation and communication between the community and the NBGO. A nine member Community Advisory Group (CAG) funded by Cadman will be formed for these purposes, with five of its members representing CGF.
  3. Through the CAG, CGF will maintain an active role working with Cadman to insure compliance with applicable laws and environmental mitigations.
  4. Cadman agreed to additional environmental protections, specifically for dust, noise and water quality. Cadman will also provide funds to the CAG to pay for a consultant to monitor data provided by Cadman.
  5. Cadman agreed to reimburse Cascade Gateway Foundation for a portion of its costs incurred to date.
  6. CGF and Cadman agreed to jointly petition King County DOT to install a traffic light at 468th Ave. SE and SE 146th Street. (By the Edgewick Inn)
  7. Cadman agreed that if concrete and asphalt plants are sought in the future, the CAG will be informed in advance and will be provided with design information before any public agency is notified. Any such plants would be enclosed and all waters generated by them would be recycled.

I can assure CGF members that Cadman VP and General Manager Barry Meade, Robin Hansen and their colleagues were candid, friendly, and professional throughout our negotiations. Our board members were impressed with their sincerity and their eagerness for a constructive, cooperative relationship during the project’s estimated twenty-five years of operation in our community.
